When Does Image Enhancement Become Manipulation?

Kofax is begun a rollout of their newest product, Virtual Rescan (VRS) Elite. I’d like to start off by saying I have pretty extensive experience with Kofax, and find it a great product. I was definitely impressed with the features I saw demonstrated with VRS Elite. VRS Elite implements some new enhancements such as hole punch removal and edge fill. This makes me wonder if legal challenges could arise if I’m provided images in a discovery response which appear to be whole, but were in fact damaged in some way.
